Refund & Cancellation Policy

1. Understanding Custom Software Development Services

Custom software development is a service-based engagement where intellectual property, time, and expertise are delivered progressively. Unlike physical products, software development involves continuous collaboration, iterative refinement, and custom solutions tailored to your specific requirements. Once development work begins and intellectual property is created, it cannot be "returned" in the traditional sense.

2. No Refund Policy - Industry Standard

In accordance with software development industry standards, all payments for custom software development services are non-refundable once work has commenced. This policy exists because:

  • Development work involves creating unique intellectual property specifically for your project
  • Time and resources allocated to your project cannot be recovered or resold
  • Our team's expertise and effort are invested from day one of the engagement
  • Project planning, architecture design, and initial setup work begins immediately upon contract signing

3. Pre-Project Cancellation

If you need to cancel before any development work begins:

  • Before Contract Signing: Full refund of any advance payments
  • After Contract Signing, Before Work Starts: Refund minus 15% administrative and planning costs
  • After Work Commencement: No refunds; see Project Termination section below

4. Milestone-Based Payment Structure

Our projects follow industry-standard milestone-based payments to protect both parties:

  • Initial Payment (30%): Covers project planning, architecture design, and setup - Non-refundable once work begins
  • Development Milestones (40%): Released upon completion and approval of specific deliverables - Non-refundable once milestone is approved
  • Final Payment (30%): Due upon project completion and delivery - Non-refundable once final deliverables are provided

Each milestone payment is earned upon delivery and client approval. Once approved, payments are final and non-refundable as the intellectual property and work product have been transferred to you.

5. Quality Assurance & Revisions

Instead of refunds, we ensure quality through:

  • Milestone Reviews: Each milestone includes review and revision cycles before approval
  • Scope Adherence: We deliver exactly what's defined in the project scope and requirements
  • Quality Standards: All code follows industry best practices and undergoes thorough testing
  • Revision Rounds: Reasonable revisions are included in each milestone to ensure satisfaction
  • Transparent Communication: Regular updates and demos throughout the development process

If deliverables don't meet the agreed specifications, we will revise them at no additional cost until they do. This is your protection and our commitment to quality.

6. Project Termination by Client

If you choose to terminate the project after work has begun:

  • Provide written notice via email to [email protected]
  • All completed and approved milestones remain non-refundable
  • Work-in-progress will be billed based on hours invested and resources utilized
  • You retain ownership of all completed work upon final payment settlement
  • Any third-party costs incurred (licenses, hosting, services) are non-refundable
  • Source code and deliverables will be provided for all paid work

7. Non-Refundable Items & Services

The following are always non-refundable under any circumstances:

  • Discovery and planning sessions
  • Technical architecture and system design documents
  • Custom UI/UX design work and prototypes
  • Completed development work and source code
  • Third-party licenses, APIs, and service subscriptions
  • Domain registrations, SSL certificates, and hosting setup
  • Time spent in meetings, consultations, and project management
  • Testing, QA, and deployment services
  • Training and documentation
  • Maintenance and support services already rendered

8. Scope Changes & Additional Work

Changes to the original project scope are handled through our change request process. Additional features or modifications beyond the original scope will be quoted separately and require additional payment. Payments for scope changes are non-refundable once work begins on the new requirements.

9. Maintenance & Support Services

For ongoing maintenance and support subscriptions:

  • Monthly Plans: Can be cancelled with 30 days written notice; no refunds for current or partial months
  • Annual Plans: Non-refundable; can be cancelled for future renewal periods only
  • Prepaid Hours: Valid for 12 months from purchase; unused hours expire and are non-refundable
  • Emergency Support: Billed and charged immediately; non-refundable once service is provided

10. Dispute Resolution

If you believe deliverables don't meet the agreed specifications:

  • Notify us in writing within 7 days of milestone delivery with specific concerns
  • We will review your concerns against the original project requirements and specifications
  • If work doesn't meet specifications, we will revise it at no additional cost
  • If work meets specifications but you want changes, it will be treated as a scope change
  • For unresolved disputes, both parties agree to mediation before pursuing legal action

11. Force Majeure & Delays

We are not liable for delays or inability to perform services due to circumstances beyond reasonable control, including natural disasters, pandemics, government actions, third-party service failures, or client-caused delays. Such circumstances do not entitle clients to refunds but may result in timeline adjustments.

12. Payment Disputes & Chargebacks

Initiating a chargeback or payment dispute without first attempting to resolve the issue directly with us is considered a breach of contract:

  • All project work will be immediately suspended
  • Access to source code, deliverables, and project materials will be revoked
  • We reserve the right to pursue legal action to recover costs and damages
  • You may be liable for chargeback fees, legal costs, and collection expenses
  • We will provide complete documentation to your payment processor showing services rendered

13. Intellectual Property Rights

Upon full payment of all invoices, you receive full ownership of the custom code and deliverables created specifically for your project. However, payments are non-refundable because the intellectual property transfer is immediate and cannot be reversed. We retain rights to reuse general methodologies, frameworks, and non-custom components in future projects.

14. Client Responsibilities

Project success requires client participation. No refunds will be issued for delays or issues caused by:

  • Failure to provide required information, content, or access in a timely manner
  • Delayed feedback or approval on milestones
  • Frequent scope changes or unclear requirements
  • Unavailability for scheduled meetings or reviews
  • Technical limitations of client's existing systems or infrastructure

15. Warranty & Post-Launch Support

We provide a warranty period (typically 30-90 days depending on package) for bug fixes related to the original scope. This warranty covers defects in our work, not new features or changes to requirements. Warranty support does not entitle clients to refunds but ensures we stand behind our work quality.

16. Changes to This Policy

We reserve the right to modify this Refund Policy at any time. Changes will be effective immediately upon posting to our website. Your continued engagement with our services after changes constitutes acceptance of the modified policy. Existing contracts will be governed by the policy in effect at the time of contract signing.
